Unless otherwise stated, these Terms apply to all current and future offerings provided by Be Your Bliss LLC.

The following names are proprietary to Be Your Bliss LLC, whether registered as trademarks or used as distinctive brand identifiers:

  • BLISS Builder™
  • BLISS Map™
  • MoodMatch™
  • Moment Makers™

You may not reproduce, distribute, modify, sell, publish, create derivative works from, or otherwise use our content without prior written permission, except as permitted by law.

You retain ownership of any journal entries, reflections, comments, reviews, community posts, or other content you voluntarily submit.

By submitting content, you grant Be Your Bliss LLC a limited, non-exclusive, worldwide, royalty-free license to store, display, process, and use such content solely as necessary to operate, maintain, and improve our services.

You represent that your content:

  • belongs to you or you have permission to submit it;
  • does not infringe another person’s rights;
  • does not violate applicable law.

  • Physical products
  • Mobile app subscriptions
  • Memberships
  • Educational content

  • Reiki sessions

  • Workshops and events

Payments may be processed through trusted third-party providers including Apple App Store, Google Play, GlossGenius, Etsy, Printify, Stripe, or other authorized providers.

Subscription renewals, cancellations, billing, and refunds are governed by the applicable platform’s policies.

Unless otherwise required by law or expressly stated, purchases are non-refundable.


9. Wellness & Medical Disclaimer

Be Your BLISS™ provides educational information and complementary wellness resources intended to support overall well-being.

Our website, app, products, services, and communications are not intended to diagnose, treat, cure, or prevent any medical or mental health condition and should not be considered a substitute for professional medical advice, diagnosis, or treatment.

Reiki, BEMER®, frequency and sound experiences, guided exercises, journal prompts, BLISS Moments™, and other offerings are complementary wellness practices. Individual experiences and results vary.

Always consult an appropriately qualified healthcare professional regarding medical concerns.

Your use of our services is also governed by our Privacy Policy.

We implement reasonable administrative, technical, and organizational safeguards to protect personal information. However, no method of electronic transmission or storage can be guaranteed to be completely secure.

Our services may integrate with or link to third-party platforms, including HubSpot, GlossGenius, Apple, Google, Etsy, Printify, payment processors, analytics providers, and other service providers.

We are not responsible for the content, availability, or privacy practices of third-party services. Your use of those services is subject to their respective terms and policies.

Where community features are available, users agree to engage respectfully.

Harassment, discrimination, misinformation, unlawful conduct, spam, or abusive behavior may result in removal of content, suspension of access, or termination of accounts.

We reserve the right to suspend or terminate access to our website, app, community, products, or services if these Terms are violated or if continued access may harm Be Your BLISS™, our users, or our business.


14. Limitation of Liability

To the fullest extent permitted by law, Be Your Bliss LLC shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of our website, app, products, or services.

Our total liability shall not exceed the amount paid by you directly to Be Your Bliss LLC during the six (6) months preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless Be Your Bliss LLC, its owners, employees, contractors, affiliates, successors, and agents from claims, damages, losses, liabilities, costs, and expenses arising from your use of our services or your violation of these Terms.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts.

Before initiating formal legal proceedings, both parties agree to make a good-faith effort to resolve disputes informally.

If a dispute cannot be resolved, it shall be submitted to binding arbitration in Norfolk County, Massachusetts, except where prohibited by applicable law.

Nothing in these Terms limits rights that cannot legally be waived.

Unless otherwise stated, these Terms apply to all current and future offerings provided through the Be Your BLISS™ application by Be Your Bliss LLC.

You represent that your content:

  • Belongs to you or you have permission to submit it;
  • Does not infringe another person's rights;
  • Does not violate applicable law.

Private wellness entries, including Sophia/MoodMatch™ responses, Reflective Writing letters, and BLISS Pulse selections, are not transmitted to or stored by Be Your Bliss LLC and are not subject to the content license described above.

  • Digital wellness content and experiences;
  • Free and paid membership access;
  • One-time purchases and subscriptions;
  • Reiki and distance Reiki sessions;
  • Live wellness workshops and events;
  • Additional services and features introduced in the future.

Payments may be processed through authorized third-party providers, including Stripe for web application purchases, Apple App Store for iOS purchases, and Google Play for Android purchases.

Membership pricing, billing frequency, renewal terms, and available benefits will be disclosed at the time of purchase.

Subscriptions may renew automatically according to the terms presented at checkout. You are responsible for managing or canceling your subscription through the applicable payment provider or purchasing platform.

Subscription renewals, cancellations, billing, and refunds are subject to the applicable platform's terms and policies, together with any rights provided by law.

If you cancel your subscription before the end of your current paid billing period, you will retain access to your membership benefits through the end of that period. Your subscription will not renew, and your membership access will end when the paid period expires, unless you renew or purchase another membership. No prorated refunds will be issued for unused time, except as required by applicable law or the purchasing platform's policies.

Unless otherwise required by applicable law or expressly stated at the time of purchase, all purchases are non-refundable.

They are not intended to diagnose, treat, cure, or prevent any medical or mental health condition and are not substitutes for professional medical advice, diagnosis, treatment, psychotherapy, counseling, or other licensed healthcare services.

Be Your Bliss LLC does not represent that its offerings can cure, prevent, or treat any illness, injury, psychological condition, or disease.

Complementary Wellness Practices

Reiki, distance Reiki, frequency and sound experiences, guided exercises, breathwork, Reflective Writing, BLISS Moments™, grief support resources, and other offerings are complementary wellness practices. Individual experiences and results vary, and no specific outcomes or benefits are guaranteed.

Personal Responsibility and Participation

Participation in any Be Your BLISS™ activity or experience is voluntary. You are responsible for determining whether an activity is appropriate for your personal circumstances, health, and well-being.

You should discontinue any activity that causes physical discomfort, dizziness, emotional distress, or other adverse symptoms and seek appropriate professional guidance when necessary.

Some wellness experiences, including breathwork, movement, emotional reflection, and grief-related content, may bring up uncomfortable physical sensations or emotions. You are encouraged to participate at your own pace and seek additional support when needed.

Professional Medical Guidance

Always consult an appropriately qualified healthcare professional regarding medical or mental health concerns, particularly before beginning activities that may affect an existing condition.

Never disregard professional medical advice or delay seeking treatment because of information obtained through Be Your BLISS™.

No Emergency or Crisis Services

Be Your BLISS™ does not provide emergency medical services, crisis intervention, suicide prevention counseling, or emergency mental health services. The application is not designed or intended to identify, monitor, assess, or respond to medical or mental health emergencies.

Members should not rely on the application, its content, community features, or communications for emergency assistance.

If you or someone else is experiencing an immediate medical or mental health emergency, contact local emergency services immediately. In the United States, call 911.

Certain application functions rely on third-party service providers that maintain their own security practices and policies. While we take reasonable measures to protect information within our control, no method of electronic transmission, processing, or storage can be guaranteed to be completely secure.

You are responsible for maintaining the security of your email account and one-time login verification codes and for promptly notifying us of any suspected unauthorized access to your account.

The Be Your BLISS™ application may integrate with, rely on, or provide access to third-party platforms and service providers, including Stripe, Apple App Store, Google Play, hosting providers, authentication services, notification services, analytics providers, and other authorized service providers.

Certain features, transactions, and services may be subject to the respective third party's terms of use, privacy policies, payment policies, and other applicable conditions.

We do not control the independent operations, content, availability, security practices, or privacy practices of third-party services.

To the fullest extent permitted by applicable law, Be Your Bliss LLC is not responsible for acts, omissions, errors, delays, service interruptions, payment processing failures, security incidents, or other failures of third-party providers to the extent such matters arise from circumstances outside our reasonable control.

Nothing in this section excludes or limits any responsibility or liability that cannot legally be excluded or limited under applicable law.

By participating in Nexus Community, you agree to engage respectfully, responsibly, and in compliance with these Terms and all applicable laws.

Member Conduct

You agree not to:

  • Engage in harassment, bullying, discrimination, threats, intimidation, hate speech, or abusive behavior;
  • Post unlawful, defamatory, fraudulent, misleading, obscene, or otherwise harmful content;
  • Promote violence, self-harm, dangerous activities, or unlawful conduct;
  • Share another person's private or confidential information without appropriate authorization;
  • Impersonate another person or misrepresent your identity, qualifications, or affiliations;
  • Distribute spam, unauthorized advertisements, solicitations, or malicious links;
  • Infringe intellectual property rights or otherwise violate the rights of others;
  • Provide medical diagnoses, prescribe treatments, or misrepresent personal opinions or experiences as professional medical or mental health advice;
  • Interfere with the operation, security, or intended purpose of Nexus Community.

Member Content and Privacy

Members are responsible for the content they choose to share.

Content posted within Nexus Community may be visible to other members. You should not share information you wish to keep private, including sensitive personal, medical, financial, or identifying information.

Be Your Bliss LLC cannot guarantee that other members will maintain the confidentiality of information voluntarily shared within the community.

Community Information and Advice

Content shared by community members reflects their individual experiences, opinions, and perspectives and does not necessarily represent the views of Be Your Bliss LLC.

Be Your Bliss LLC does not endorse, verify, or guarantee the accuracy, reliability, safety, or appropriateness of member-generated content.

Community discussions are intended for general connection and peer support. They are not substitutes for professional medical, psychological, legal, financial, or other qualified advice.

Moderation and Enforcement

Be Your Bliss LLC reserves the right, but does not undertake a general obligation, to review, moderate, restrict, or remove community content and to suspend or terminate a member's access to Nexus Community or the application when we reasonably determine that content or conduct:

  • Violates these Terms or applicable law;
  • Threatens the safety, privacy, or rights of others;
  • Disrupts the community or application;
  • Exposes Be Your Bliss LLC, its members, or others to potential harm or legal risk.

We may take such action without prior notice where permitted by applicable law.

We do not guarantee that all inappropriate, inaccurate, offensive, or harmful content will be identified or removed.

Nothing in these Terms limits any legal obligation to address unlawful content or comply with applicable law.

No Emergency Monitoring

Nexus Community is not an emergency response, crisis intervention, or mental health support service.

Be Your Bliss LLC does not provide continuous monitoring of community discussions and does not guarantee immediate review, intervention, or response to member content.

Members should not rely on Nexus Community, its members, or Be Your Bliss LLC for emergency assistance.

If you or someone else is experiencing an immediate medical or mental health emergency, contact local emergency services. In the United States, call 911.

Member Responsibility

Each member is responsible for the content they post, the information they share, and their communications and interactions with other members.

To the fullest extent permitted by applicable law, Be Your Bliss LLC is not responsible for the independent statements, opinions, advice, conduct, or actions of community members, or for losses or damages arising from member interactions, except to the extent such responsibility or liability cannot legally be excluded or limited.

Right to Suspend or Terminate Access

To the fullest extent permitted by applicable law, Be Your Bliss LLC reserves the right, in its discretion, to suspend, restrict, or terminate any user's access to the Be Your BLISS™ application, Nexus Community, or any related features or services, with or without cause and with or without prior notice.

We may exercise this right for reasons including, but not limited to:

  • Violations of these Terms or applicable law;
  • Harassment, threats, abusive conduct, or behavior that may harm members or the community;
  • Misuse of the application, its content, or its features;
  • Suspected unauthorized access, compromised accounts, or security risks;
  • Fraudulent activity, unauthorized transactions, or misuse of payment systems;
  • Conduct that threatens the safety, privacy, rights, security, or legitimate interests of Be Your Bliss LLC, its members, or others;
  • Any other lawful reason, including circumstances in which we determine that continued participation is not appropriate for the application or community.

We are not required to disclose the specific reason for a suspension or termination except where required by applicable law.

Enforcement Actions

Depending on the circumstances, Be Your Bliss LLC may remove content, restrict access to particular features, temporarily suspend an account, or permanently terminate access.

We may take such action without prior notice where permitted by applicable law.

All suspension and termination decisions will be exercised in accordance with applicable law, including relevant consumer protection, anti-discrimination, and contractual obligations.

Nothing in this section permits termination for an unlawful reason or limits rights or remedies that cannot legally be waived.

To the fullest extent permitted by applicable law, Be Your Bliss LLC reserves the right, in its sole discretion, to suspend, restrict, or terminate any user's access to the Be Your BLISS™ application, Nexus Community, or any related features or services, at any time, for any lawful reason or no stated reason, with or without prior notice, subject to applicable law.

To the fullest extent permitted by applicable law, Be Your Bliss LLC, including its owners, officers, employees, contractors, agents, affiliates, and representatives, shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the use of, inability to use, or reliance upon the Be Your BLISS™ application, its content, features, community, or services.

This includes, without limitation, claims involving loss of data, loss of profits, business interruption, emotional distress, or other consequential losses, to the extent such damages may lawfully be excluded.

Wellness Experiences and Individual Outcomes

Be Your BLISS™ provides educational content, general wellness resources, and complementary wellness experiences.

Individual experiences and results may vary. Be Your Bliss LLC does not guarantee any particular physical, emotional, psychological, spiritual, or wellness outcome.

To the fullest extent permitted by applicable law, Be Your Bliss LLC shall not be liable for damages arising from a user's voluntary participation in wellness activities, reliance on educational content, or use of complementary wellness services, except to the extent such liability cannot legally be excluded.

Nexus Community and Member-Generated Content

Be Your Bliss LLC does not guarantee the accuracy, reliability, safety, or appropriateness of content posted by community members.

To the fullest extent permitted by applicable law, Be Your Bliss LLC shall not be liable for damages arising from independent member-generated content, advice, statements, or interactions, except to the extent responsibility cannot legally be excluded.

Third-Party Services and Technology

The application may depend on third-party providers for hosting, payment processing, authentication, notifications, and other functions.

To the fullest extent permitted by applicable law, Be Your Bliss LLC shall not be liable for damages resulting from service interruptions, technical failures, unauthorized third-party actions, payment processing errors, or other circumstances outside its reasonable control, except to the extent responsibility cannot legally be excluded.

Application Availability and Data

Be Your Bliss LLC does not guarantee that the application or its features will be uninterrupted, error-free, continuously available, or free from all security vulnerabilities.

To the fullest extent permitted by applicable law, Be Your Bliss LLC shall not be liable for damages arising from temporary unavailability, technical errors, data loss, or disruptions beyond its reasonable control, except to the extent responsibility cannot legally be excluded.

Maximum Aggregate Liability

To the fullest extent permitted by applicable law, the total aggregate liability of Be Your Bliss LLC and the parties identified in this section for all claims arising out of or relating to the application, its content, or services shall not exceed the greater of (a) the total amount paid by you for the Be Your BLISS™ application and its services during the six (6) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

This limitation applies to the extent permitted by applicable law, regardless of the legal theory under which a claim is brought, including contract, tort, or otherwise.

Exceptions and Applicable Law

Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, fraud, or any other liability that cannot lawfully be excluded or limited.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, the limitations above apply only to the maximum extent permitted by applicable law.

  • Content you submit, publish, or share through Nexus Community or other interactive features, including content that infringes or violates another person's intellectual property, privacy, or other legal rights;
  • Your unlawful, fraudulent, abusive, or otherwise prohibited conduct;
  • Your interactions with other users or third parties, to the extent a claim arises from your own actions or omissions.

Your indemnification obligations apply only to the extent the claim, loss, or expense is attributable to your conduct and may lawfully be imposed upon you.

Be Your Bliss LLC reserves the right to assume control of the defense of any claim subject to indemnification, using counsel of its choosing, at its own expense. You agree to provide reasonable cooperation in the defense of such claims.

You will not be required to indemnify Be Your Bliss LLC for claims arising from the company's own negligence, misconduct, or violation of applicable law to the extent such indemnification is prohibited by law.

Nothing in this section limits any rights or protections that cannot legally be waived under applicable consumer protection laws.

Informal Dispute Resolution

Before initiating formal legal proceedings, you and Be Your Bliss LLC agree to make a good-faith effort to resolve disputes informally.

Both parties agree to allow thirty (30) days from receipt of written notice to attempt resolution before initiating arbitration or other formal proceedings, unless immediate action is necessary to preserve legal rights, seek emergency relief, or comply with applicable law.

Binding Arbitration

If a dispute cannot be resolved informally, you and Be Your Bliss LLC agree that disputes arising out of or relating to these Terms, the application, or its services shall be resolved through binding arbitration, rather than in court, to the fullest extent permitted by applicable law.

This agreement to arbitrate applies to both you and Be Your Bliss LLC.

Arbitration shall be administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, as modified by this section only to the extent permitted by those rules and applicable law.

The Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration agreement to the extent applicable.

Unless the parties agree otherwise, the designated arbitration location shall be Norfolk County, Massachusetts. Consumers may participate remotely or use another location when required by applicable law or the governing arbitration rules.

Arbitration fees and costs shall be allocated in accordance with the applicable arbitration rules and law. Nothing in these Terms requires a consumer to pay arbitration costs that applicable law or governing consumer arbitration rules prohibit.

The arbitrator may award any individual relief or remedy available under applicable law.

Exceptions to Arbitration

Either party may bring an eligible individual claim in small claims court rather than arbitration.

Nothing in this section prevents either party from seeking emergency or temporary injunctive relief from a court of competent jurisdiction when legally permitted.

Nothing in this section prevents users from exercising rights that applicable law makes nonwaivable, including the right to file complaints with governmental or regulatory authorities.

Court Proceedings

If a dispute is not subject to arbitration or an arbitration provision is found unenforceable, the dispute may be brought before a court of competent jurisdiction in Massachusetts, subject to applicable law and any mandatory consumer venue protections.

Severability

If any portion of this dispute resolution provision is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the fullest extent permitted by applicable law, unless the invalid provision is essential to the agreement to arbitrate.

Preservation of Legal Rights

Nothing in this section excludes, restricts, or waives any legal right, remedy, or protection that cannot lawfully be excluded, restricted, or waived.
